En la Audiencia Provincial de Las Palmas, hubo una sentencia destacada (n\u00fam. 84\/2018) relativa a la ca\u00edda de un jinete durante una clase de equitaci\u00f3n. La sentencia concluy\u00f3 que, en este tipo de deporte, el riesgo de ca\u00edda es un aspecto inherente a la pr\u00e1ctica y, por lo tanto, es un riesgo asumido por el alumno.\u00a0<\/span><\/p>\n<p dir=\"auto\" style=\"text-align: justify;\"><span style=\"color: #000000;\">En este contexto, la teor\u00eda del riesgo establece que quien participa en actividades deportivas peligrosas, como la h\u00edpica, acepta los posibles da\u00f1os asociados, especialmente cuando estos son inevitables y comunes en la pr\u00e1ctica. Sin embargo, existe responsabilidad del profesor o la escuela de equitaci\u00f3n si se demuestra una negligencia clara, como una falta de medidas de seguridad adecuadas o instrucciones inapropiadas para el nivel del alumno.
